Obama pushed on contractor disclosure (Politico)

More than 60 House Democrats urged President Barack Obama Thursday to sign a controversial executive order they say would promote corporate accountability on political giving, but that conservatives allege is an attempt to intimidate administration critics.

The order would require companies seeking government contracts to disclose political contributions ? including those that otherwise would have been secret to groups that air political ads attacking or supporting candidates.

While supporters billed the order as an effort to crack down on pay-to-play contracting, Obama seemed to back off plans to sign it after a leaked draft in April prompted an outcry among congressional Republicans and their allies, including the powerful U.S. Chamber of Commerce, which questioned its constitutionality and blasted it as an effort to use executive power to punish or silence political adversaries and reward supporters.

But in their letter, House Democrats urged him to ?to respond forcefully? to the criticism by signing the order.

?We believe that with public funds come public responsibilities, and anyone benefitting from taxpayer money has the responsibility to be fully transparent,? reads the letter, which was spearheaded by California Rep. Anna Eshoo, who had pushed legislative efforts to enact similar disclosure requirements even before the order leaked, and, since then, has taken a leading role in pushing back against GOP attacks on the order.

In a statement released with the letter, Eshoo urged Obama to sign the order and proclaimed, ?We will stand with the president for transparency.?

In May, Reps. Darrell Issa (R-Calif.) and Tom Cole (R-Okla.) introduced legislation to block the executive order by barring the federal government from collecting or using information about federal contractors? political spending.

In a statement explaining his motivation, Issa ? who also threatened to subpoena an administration witness to testify at a hearing on the draft order before his Oversight & Government Reform committee ? said, ?Businesses should not have to determine and report to the government on whether certain employees contributed to organizations that support or oppose positions on issues including gay marriage and abortion.?

Chesapeake Energy's 2Q profit nearly doubles (AP)

OKLAHOMA CITY ? Chesapeake Energy Corp. said Thursday that its second-quarter net income nearly doubled as production increased and prices rose for oil and natural gas liquids.

The Oklahoma City energy producer said net income totaled $467 million, or 68 cents per common share, in the April-to-June quarter. That compared with net income of $235 million, or 37 cents a share, a year ago.

Total revenue rose 65 percent to $3.32 billion from $2.01 billion.

Special items included a $122 million loss related to the purchase of senior notes and a loss on foreign currency derivatives. Excluding those, Chesapeake said its earnings were $528 million, or 76 cents per share, in the most recent quarter.

The company said its average daily production totaled 3.05 billion cubic feet equivalent, an increase of 9 percent from the year-ago quarter.

The company recorded an 8 percent drop in the average, realized price for natural gas while the average combined realized price for oil and natural gas liquids rose 6 percent.

Chesapeake forecast 2011 natural gas production of 1.17 trillion cubic feet equivalent and 2012 production of 1.35 trillion cubic feet.

Separately, Chesapeake announced it has made a liquids discovery in the Utica Shale region and said it believes its 1.25 million net acres in the region could be worth $15 billion to $20 billion in increased value to the company.

Chesapeake released its earnings after the market closed Thursday. Its shares closed up 3 cents at $33.43 and increased 59 cents in after-hours trading.

Egyptian Islamists, others gather to show unity (Reuters)

CAIRO (Reuters) ? Thousands of Egyptians gathered in Cairo's Tahrir Square on Friday to show Islamists and others were united in wanting change, though divisions remain on how hard to press the military rulers about the pace and depth of reforms.

Muslim chants such as "There is no God but God" and "Islamiya, Islamiya" dominated. Some waved banners saying "Islamic Egypt." A senior Muslim Brotherhood official described the rally as a "Friday of unity of all political forces."

Some protesters chanted "People and army, hand in hand."

The Brotherhood and other Islamists had joined a big rally with other groups on July 8 demanding a deeper purge of officials who served under ousted President Hosni Mubarak and swifter corruption trials. But since then have stepped back.

Islamists said they wanted to give the army time to respond. Other groups, such as the April 6 movement, have kept up the pressure with some camping out in Tahrir.

"We are glad political forces are showing a united front at this critical juncture in the revolution," Mohamed Adel, spokesman for April 6 said ahead of the rally.

Some protesters accuse the Brotherhood, which was banned under Mubarak but now enjoys unprecedented freedoms, of making a pact with the army. The group dismisses the charge.

Protesters marched on the Defense Ministry and other military sites in Cairo and other cities last weekend. In the capital, demonstrators clashed with stone-throwing youths while soldiers forming a cordon did little to intervene.

The army rulers, in an unusually blunt statement, accused April 6 of trying to divide the people and the army, which has drawn fire for continuing to use military trials for civilians and failing to move more swiftly to try Mubarak and his allies.

In a show of support for April 6, Mohamed Beltagy, a member of the Muslim Brotherhood's Freedom and Justice Party, said: "The Brotherhood rejects discrediting and distorting any revolutionary force that chooses to rally peacefully."

April 6 has dismissed the army criticism and said it would not ease off the pressure.

"The latest attempts to marginalize us have not worked because the opposition knows if one group gets demonized then that eventually will harm all other groups keen on protecting the gains of the revolution," said Adel of the April 6.

One of the persistent protester demands has been for a swifter trial of Mubarak, who was ousted on February 11 after an 18-day uprising. His trial is now set for August 3 but protesters accuse the army of dragging its feet and being reluctant to hold their former commander-in-chief to account.

Mubarak has been in a hospital in the Red Sea resort of Sharm el-Sheikh since April when he was first questioned, and is now detained there. But he has not been transferred to a prison like his two sons and other officials due to illness.

A source close to Mubarak said his lawyer would tell the court in Cairo next week that he was too sick to attend the opening session.

Many Egyptians see Mubarak's illness as a ploy to avoid publicly humiliating the former president.

VIENNA ? Diplomats say Iran is lagging behind on plans to increase production of uranium enriched to a grade that can be turned quickly into the material used to arm nuclear warheads.

They tell The Associated Press Friday that as of July 23 Tehran had not set up enriching equipment at a bunker planned for that purpose, and say Iran now plans to produce less of the higher-enriched uranium at the site than originally envisaged.

Diplomats say only half of the approximately 1,000 centrifuges to be installed ? instead of all ? will churn out higher-enriched uranium. The rest will produce material that is more difficult to turn into warhead cores

Plans were to have the enriching centrifuges installed by the end of July.

The diplomats asked for anonymity because their information is confidential.

Health Care Battle Reaches Supreme Court - The BLT: The Blog of ...

The titanic battle over federal health care reform is now before the U.S. Supreme Court.

The Thomas More Law Center today announced that it had filed its petition for certiorari in Thomas More Law Center v. Obama, its challenge to a June 29 ruling by the U.S. Court of Appeals for the 6th Circuit that upheld the so-called "individual mandate" under the landmark health care legislation. That provision of the Patient Protection and Affordable Care Act requires individuals to purchase at least minimum health care insurance coverage.

"Review is necessary to establish a meaningful limitation on congressional power under the Commerce Clause," the petition argues. "If the Act is understood to fall within Congress?s Commerce Clause authority, the federal government will have absolute and unfettered power to create complex regulatory schemes to fix every perceived problem imaginable and to do so by ordering private citizens to engage in affirmative acts, under penalty of law."

As examples, the brief asserts that if the individual mandate is upheld in the health care arena, government would feel free to order citizens to take vitamins, join health clubs, or buy General Motors cars.

The petition may be at the leading edge of a wave of litigation over the controversial legislation, challenging the first of several expected appeals court rulings in coming months.

Because the 6th Circuit is the only appeals court that has ruled thus far, the petition could not make what is usually the strongest argument for review by the Supreme Court: the need to resolve a split among circuits.

Instead, the brief cites a rule of the Supreme Court suggesting that review is appropriate when "a United States court of appeals has decided an important question of federal law that has not, but should be, settled by this Court."

The petition cites the line of cases mainly from the Rehnquist Court seeking to limit the power of Congress under the Constitution's Commerce Clause. Those precedents, the petition states, mean that "before Congress can reach you through the Commerce Clause, you must be engaged in some affirmative activity."

Two of the three members of the 6th Circuit panel agreed, for different reasons, that the government had made a plausible case that the individual mandate is constitutional because an individual's decision not to obtain health coverage has economic consequences. The judges were Boyce Martin and Jeffrey Sutton. Sutton's opinion has been viewed as especially important because he is a respected conservative judge who, as appellate lawyer, often argued in favor of state sovereignty. The dissenting judge in the 6th Circuit case was Ohio U.S. District Court Judge James Graham, sitting by designation.

The petition was filed by Thomas Muise of the Ann Arbor, Michigan-based More Center. David Yerushalmi of the Law Offices of David Yerushalmi in Chandler, Arizona, was also on the brief. Following a reply by the Obama administration, the case would likely be weighed by the justices at the Court's private conference in late September, though it could also consider the petition during the summer recess.

Shell profits soar on high oil prices (AFP)

LONDON (AFP) ? Royal Dutch Shell on Thursday said that net profits almost doubled to $8.6 billion (6.0 billion euros) in the second quarter as improved income from high oil prices offset a drop in production.

"Our second quarter 2011 earnings were higher than year-ago levels, driven by increased energy prices and Shell's operating performances," company chief executive Peter Voser said in a statement.

Profits in the second-quarter of 2010 were $4.5 billion.

Oil prices soared during the reporting period amid violent unrest in the crude-producing Middle East and North Africa region.

Shell added that production dropped in the quarter by 2.0 percent to 3.0 million barrels of oil equivalent per day.

Voser said that the outlook for the rest of the year was positive.

"We have made important progress with new production in 2011, and the ramp-up of our new projects should drive our financial performance in the coming quarters," he said.

Shell's update comes two days after rival BP said it had bounced back into profit in the second quarter thanks to high oil prices and after a huge loss last year caused by costs linked to the Gulf of Mexico oil spill disaster.

"Without the distractions which have plagued arch rival BP, Shell has been able to capitalise on higher energy prices and the bottom line performance is stark confirmation of the gap between the two," Richard Hunter, head of UK equities at Hargreaves Lansdown Stockbrokers, said following Shell's results.

"Shell is also looking further ahead, with a major investment programme over the next three years already underway in countries such as Canada and Qatar."

He added that potential blind spots relating to the group's prospects tended to be industry wide "rather than Shell specific, such as many governments looking to increase their tax take on oil companies and the shadow cast over the sector from the Gulf of Mexico spill."

A leak triggered by an explosion on the BP-leased Deepwater Horizon rig in the US Gulf of Mexico on April 20, 2010 killed 11 workers, caused millions of barrels of oil to spew into the sea and left the BP with huge compensation costs.

Texas Health Insurance Rate Hikes Could Be Capped By Fall | Bigger ...

Texas health insurance is on a collision course with regulation when it comes to rate increases. Starting in September, rate hikes of 10 percent or more will be under greater scrutiny. The Obama administration just finalized rules that could help keep health coverage rates low.

Large employers? health insurance options won?t be affected by the new rules yet, but officials plan to seek input on whether to expand the rules to what are known as ?association health plans.? That refers to policies that are pooled together in large groups.

Rate hikes on Texas health insurance plans may be reviewed by the state or the federal government. Although insurers will be called upon to explain the need to raise premiums, the federal government doesn?t actually have the authority to block increases. Many state regulators, however, already have that power. Some that don?t are pushing to get it.

Will Health Insurance For Texas Really Change?

For the state of Texas, health insurance companies may see a big difference. Before this fall, the Texas Department of Insurance was not requiring insurers to justify rate hikes unless there was a 50-percent increase from one year to the next. In fact, the old law did not even mandate that the department review rates or compare them to any standard.

The days of rate hikes appearing in your mail box with little or no overview may be gone. The new scenario prompts insurance companies to outline their spending for administrative costs and medical services, and takes a look at their profit margins.

Texas health insurance companies are likely to notice a major shift. According to the secretary of Health and Human Services, ?Recently, insurers have posted some of their highest profits in years?and they continue to raise rates, often without any explanation or justification.? Kathleen Sebelius says, ?The framework of the Affordable Care Act is beginning to change this.?

Should Texas Health Insurance Quotes Be Lower?

While premiums have continued to rise, sometimes by 30, 40, 50 or almost 60 percent, some insurers have been spending less on medical care. Without the means to meet co-pays or deductibles, policyholders have cut back on health care during the ongoing recession. That?s unlikely to reverse until unemployment is resolved.

Now that health insurance plans in Texas purchased after the passage of health care reform provide preventive care at no cost to the policyholder, long-term costs are further expected to be curbed. Of course, insurers will initially spend more on preventive services like annual exams, but that?s a tiny fraction of the cost to treat illness that has progressed unimpeded.

Cash-strapped consumers now have access to see their doctor yearly. It?s cheaper for the policyholder and the insurer to spend minimal amounts to treat disease early on than to spend exorbitant amounts that may or may not save lives once a disease like cancer has progressed.

Are Insurance Companies In Favor Of Health Care Reform?

Despite the opposition of insurers to regulation, they sometimes argue for reform whether they realize it or not. For example, the head of America?s Health Insurance Plans says, ?Premium review must adequately factor in all of the components that determine premium rates, including geographic variation, the cost of new benefit mandates, and the impact of younger and healthier people dropping coverage.?

By requiring most U.S. citizens to carry minimal levels of health insurance, health care reform prevents young, healthy individuals from opting out. That?s the basis for universal coverage in most of the developed world. Share the cost so that the impact of caring for the sickest among us is spread across the total population.

As to any variation in geographic medical costs, states will develop their own thresholds to take into account regional conditions in the coming years. The 10-percent increase standard is just a starting point.

Some consumer groups have taken issue with that as well. They have written the secretary of Health and Human Services calling for additional measures that would review premium hikes that are not justified by medical treatment inflation.

Drug prices to plummet in wave of expiring patents (AP)

The cost of prescription medicines used by millions of people every day is about to plummet.

The next 14 months will bring generic versions of seven of the world's 20 best-selling drugs, including the top two: cholesterol fighter Lipitor and blood thinner Plavix.

The magnitude of this wave of expiring drugs patents is unprecedented. Between now and 2016, blockbusters with about $255 billion in global annual sales are set to go off patent, notes EvaluatePharma Ltd., a London research firm. Generic competition will decimate sales of the brand-name drugs and slash the cost to patients and companies that provide health benefits.

Top drugs getting generic competition by September 2012 are taken by millions every day: Lipitor alone is taken by about 4.3 million Americans and Plavix by 1.4 million. Generic versions of big-selling drugs for blood pressure, asthma, diabetes, depression, high triglycerides, HIV and bipolar disorder also are coming by then.

The flood of generics will continue for the next decade or so, as about 120 brand-name prescription drugs lose market exclusivity, according to prescription benefit manager Medco Health Solutions Inc.

"My estimation is at least 15 percent of the population is currently using one of the drugs whose patents will expire in 2011 or 2012," says Joel Owerbach, chief pharmacy officer for Excellus Blue Cross Blue Shield, which serves most of upstate New York.

Those patients, along with businesses and taxpayers who help pay for prescription drugs through corporate and government prescription plans, collectively will save a small fortune. That's because generic drugs typically cost 20 percent to 80 percent less than the brand names.

Doctors hope the lower prices will significantly reduce the number of people jeopardizing their health because they can't afford medicines they need.

Dr. Nieca Goldberg, director of The Women's Heart Program at NYU Langone Medical Center in Manhattan, worries about patients who are skipping checkups and halving pills to pare costs.

"You can pretty much tell by the numbers when I check the patient's blood pressure or cholesterol levels," that they've not taken their medications as often as prescribed, she says.

Even people with private insurance or Medicare aren't filling all their prescriptions, studies show, particularly for cancer drugs with copays of hundreds of dollars or more.

The new generics will slice copayments of those with insurance. For the uninsured, who have been paying full price, the savings will be much bigger.

Daly Powers, 25, an uninsured student who works two part-time jobs at low wages, says he often can't afford the $220 a month for his depression and attention deficit disorder pills. He couldn't buy either drug in June and says he's struggling with his Spanish class and his emotions. He looks forward to his antidepressant, Lexapro, going generic early next year.

"It'd make all the difference in the world," says Powers, of Bryan, Texas.

Generic medicines are chemically equivalent to the original brand-name drugs and work just as well for nearly all patients.

When a drug loses patent protection, often only one generic version is on sale for the first six months, so the price falls a little bit initially. Then, several other generic makers typically jump in, driving prices down dramatically.

Last year, the average generic prescription cost $72, versus $198 for the average brand-name drug, according to consulting firm Wolters Kluwer Pharma Solutions. Those figures average all prescriptions, from short-term to 90-day ones.

Average copayments last year were $6 for generics, compared with $24 for brand-name drugs given preferred status by an insurer and $35 for nonpreferred brands, according to IMS Health.

Among the drugs that recently went off patent, Protonix, for severe heartburn, now costs just $16 a month for the generic, versus about $170 for the brand name. And of the top sellers that soon will have competition, Lipitor retails for about $150 a month, Plavix costs almost $200 a month and blood pressure drug Diovan costs about $125 a month. For those with drug coverage, their out-of-pocket costs for each of those drugs could drop below $10 a month.

Jo Kelly, a retired social worker in Conklin, Mich., and her husband Ray, a retired railroad mechanic, each take Lipitor and two other brand-name medicines, plus some generic drugs. Both are 67, and they land in the Medicare prescription "doughnut hole," which means they must pay their drugs' full cost, by late summer or early fall each year. That pushes their monthly cost for Lipitor to about $95 each, and their combined monthly prescription cost to nearly $1,100.

Generic Lipitor should hit pharmacies Nov. 30 and cost them around $10 each a month.

"It would be a tremendous help for us financially," she says. "It would allow us to start going out to eat again."

For people with no prescription coverage, the coming savings on some drugs could be much bigger. Many discount retailers and grocery chains sell the most popular generics for $5 a month or less to draw in shoppers.

The impact of the coming wave of generics will be widespread ? and swift.

Insurers use systems that make sure patients are switched to a generic the first day it's available. Many health plans require newly diagnosed patients to start out on generic medicines. And unless the doctor writes "brand only" on a prescription, if there's a generic available, that's almost always what the pharmacist dispenses.

"A blockbuster drug that goes off patent will lose 90 percent of its revenue within 24 months. I've seen it happen in 12 months," says Ben Weintraub, a research director at Wolters Kluwer Pharma Solutions.

The looming revenue drop is changing the economics of the industry.

In the 1990s, big pharmaceutical companies were wildly successful at creating pills that millions of people take every day for common conditions, from heart disease and diabetes to osteoporosis and chronic pain. Double-digit quarterly profit increases became the norm.

But the patents on those blockbusters, which were filed years before the drugs went on sale, last for 20 years at most, and many expire soon.

In recent years, many drug companies have struggled to develop new blockbuster drugs, despite multibillion-dollar research budgets and more partnerships with scientists at universities and biotech companies. The dearth of successes, partly because the "easy" treatments have already been found, has turned the short-term prognosis for "big pharma" anemic.

"The profit dollars that companies used to reinvest in innovation are no longer going to be coming," warns Terry Hisey, life sciences leader at consultant Deloitte LLP's pharmaceutical consulting business. He says that raises "long-term concerns about the industry's ability to bring new medicines to market."

But pharmaceutical companies can save billions when they stop promoting drugs that have new generic rivals, and U.S. drug and biotech companies are still spending more than $65 billion a year on R&D.

The 20 new drug approvals in the U.S. this year, and other important ones expected in the next few years, eventually will help fill the revenue hole.

For now, brand-name drugmakers are scrambling to adjust for the billions in revenue that will soon be lost. Many raise prices 20 percent or more over the last couple years before generics hit to maximize revenue. Some contract with generic drugmakers for "authorized generics," which give the brand-name company a portion of the generic sales.

Brand-name companies also are trimming research budgets, partnering with other companies to share drug development costs and shifting more manufacturing and patient testing to low-cost countries.

Pharmaceutical companies have cut about 10 percent of U.S. jobs in four years, from a peak of about 297,000 to about 268,000, according to Labor Department data. Nearly two-thirds of the cuts came in the last 1 1/2 years, partly because of big mergers that were driven by the need to shore up pipelines and boost profit in the short term by slashing overlap.

Drug companies also are trying to stabilize future sales by putting more sales reps in emerging markets such as China and India, and diversifying into businesses that get little or no generic competition. Those include vaccines, diagnostic tests, veterinary medicines and consumer health products.

As the proportion of prescriptions filled with generic drugs jumped to 78 percent in 2010, from 57 percent in 2004, annual increases in prescription drug spending slowed, to just 4 percent in 2010. According to the Generic Pharmaceutical Association, generics saved the U.S. health care system more than $824 billion from 2000 through 2009, and now save about $1 billion every three days.

The savings are only going to get greater as our overweight population ages. People who take their medicines regularly often avoid costly complications and hospitalizations, says AARP's policy chief, John Rother, bringing the system even bigger savings than the cheaper drugs.

In addition, many patients taking a particular brand-name drug will defect when a slightly older rival in the same class goes generic.

Global sales of Lipitor peaked at $12.9 billion in 2006, the year Zocor, an older drug in the statin class that reduces bad cholesterol, went generic. Lipitor sales then declined slowly but steadily to about $10.7 billion last year. That still makes Lipitor the biggest drug to go generic.

For patients, it's a godsend.

Douglas Torok, 59, of Erie, Pa., now spends nearly $290 every three months for insulin for his Type 2 diabetes, plus four daily pills, including Lipitor, Plavix and two generics, for his blood pressure and cholesterol problems. The $40,000-a-year foundry supervisor fears not being able to cover the out-of-pocket costs when he retires and doesn't have a generous prescription plan.

In the meantime, once Lipitor and Plavix get generic competition his copayment will plunge from the current $1 per day for each.

"I will pay $16 for 90 days" for both, says Torok, who hopes to travel more. "It's a big deal for me on my income."

Learn to expand time by awaking to the NOW of what you love in this moment. Let yourself FEEL your connection to your lover in each hug, each kiss, as you listen and notice. This is where the sweetest of life happens ? and where your deepest restorative breath can be found.

Character actor G.D. Spradlin dies in CA at 90 (AP)

LOS ANGELES ? Gervase Duan "G.D." Spradlin, a former lawyer and oil producer who found a second act as a prolific character actor, playing authority figures in such films as "Apocalypse Now" and "The Godfather: Part II," has died. He was 90.

Spradlin died of natural causes Sunday at his San Luis Obispo ranch in Central California, his grandson Justin Demko told the Los Angeles Times on Monday.

Born on Aug. 31, 1920, in Pauls Valley, Okla., Spradlin turned to acting in his 40s after serving in the Army Air Forces in China during World War II, working as an attorney for Phillips Petroleum Co. and striking it rich as an independent oil producer. He also dabbled in politics as director of John F. Kennedy's 1960 presidential campaign in Oklahoma and had an unsuccessful run for mayor of Oklahoma City in 1965.

Spradlin got his start in acting after taking his daughter Wendy to audition for a local production of "Cat on a Hot Tin Roof" and wound up landing a part in the play himself.

"Being rich changes surprisingly little," Spradlin told the Times in 1967. "You'll still have to have an absorbing interest in life, something to do to make you feel alive."

When he moved his family to Los Angeles, he found steady work playing politicians, preachers, doctors, judges and military officers.

In a career spanning more than three decades, his most notable parts include the corrupt senator in "The Godfather: Part II," and the Army general who sent Martin Sheen up river to find and kill Marlon Brando's Col. Kurtz in "Apocalypse Now."

His other film credits include "The War of the Roses" and "Ed Wood." He retired after playing Washington Post editor Ben Bradlee in the 1999 comedy "Dick."

Spradlin's first wife, Nell, with whom he had daughters Tamara Kelly and Wendy Spradlin, died in 2000. He's survived by his second wife, Frances Hendrickson, his two daughters and five grandchildren.
